Terms and Conditions of use for Sovereign Sunshine website
Please note that all use of the Sovereign Sunshine website (the "Website") and all information and services available through the Website are governed by the terms set out below (the “Terms”) and that by using the Website you unconditionally agree to be bound by these Terms.
The Sovereign Sunshine website is run by Sovereign Services Limited, a member of the Sovereign Group of Companies. On this website and in these Terms all references to “Sovereign”, “we”, “us” are reference to Sovereign Services Limited and the Sovereign Group of Companies (“Sovereign”).
Sovereign reserves the right to vary the information on the Website, including these Terms and any information regarding Sovereign Sunshine, at any time without notice. Please check these Terms periodically for changes. The continued use of the Website, following changes to the Terms, is acceptance of those changes.
General Information
The information provided by Sovereign on the Website is only for limited purposes relating to the running of the Sovereign Sunshine charitable programme and is general information only. While we have endeavoured to ensure that the content and material on the Website is free from error, Sovereign does not warrant its accuracy, adequacy or completeness or that it is suitable for any intended use. In no event shall Sovereign be responsible for any loss or damage of whatever kind arising out of access to, use of, or reliance on, any information available through the Website or any hyperlink to any website or any information contained or accessed through the Website. None of Sovereign, any of its directors, officers, employees or agents, or any other party involved in creating, producing or delivering the Website, is liable for any direct, incidental, consequential, indirect or punitive damages, which are excluded to fullest extent permitted by law, arising out of your access to, or use of or inability to use, the Website or arising from your reliance or non-reliance on the content available on or through the Sovereign Site.
Registration and Username
To use all the functions of the Website you must register through the Website and meet registration requirements. A person may only register once for the Website. When registering you will be asked to provide Sovereign with personal information. Any information supplied must be correct and will be relied upon by Sovereign in operating the Website and the Monthly Prize Draw. This information is subject to the Privacy Statement and will only be accessed and used by Sovereign and Sovereign’s authorised agents on the terms therein.
In order to fully use the Website (including voting for a charity) you are required to supply Sovereign with information including a valid email address and a username. Sovereign reserves the right to refuse access to any person seeking to use the Website for any reason, including where the email or username is deemed by Sovereign to be offensive. Where Sovereign determines that a person has registered more than once Sovereign reserves the right to remove such registrations and invalidate any vote or Monthly Prize Draw entry of that person.
Monthly Prize Draw
Where a monthly prize draw is included on the Website it will be offered by Sovereign. To be eligible to enter a monthly prize draw you must be resident in New Zealand and have registered for the Website and cast a valid vote for a shortlisted children’s charity for that month. Each valid vote cast for a shortlisted charity prior to the close of that monthly vote, will be included in a random draw for the monthly prize. A registered member will only be entered into the monthly prize draw once for each monthly vote.
The monthly prize may differ in value and composition and is not transferable or redeemable for cash and to the extent permitted by law Sovereign will not be liable for costs or damages in relation to, or arising out of, any monthly prize. All prize decisions are final and no correspondence will be entered into.
In accepting any prize the prize winner agrees to participate in any publicity arrangements that Sovereign may require in relation to the monthly prize draw including the publication of their details as a prize winner.
Sovereign reserves the right to vary, suspend or terminate the monthly prize draw at any time.
From time to time Sovereign may run additional promotions and prize draws in relation to the Website. Any further terms and conditions for these promotions will be notified through the Website.
Voting Close off
Monthly voting for each shortlist of charities, and entry into each monthly prize draw, closes at midday on the last business day of the respective month. Voting for the next shortlist of charities begins after midday on the last business day of the previous month.
Sovereign Sunshine Charities
To be included in the Sovereign Sunshine program a charity must be a registered New Zealand charity under the Charities Act 2005 and have a children-related charitable purpose and have completed any registration requirements advised by Sovereign. The decision of whether a registered charity has a children-related purpose is solely a decision for Sovereign. Sovereign makes no representations regarding the position of any charity which participates in the Sovereign Sunshine programme.
The inclusion of a charity in the Sovereign Sunshine programme for a particular month does not guarantee the inclusion of that charity for any subsequent period. Sovereign reserves the right to remove amend or substitute a particular charity from the Sovereign Sunshine programme in accordance with the Terms and Conditions outlined here.
All charities participating in Sovereign Sunshine do so on the condition and warrant that the charity has checked with existing sponsors and no conflict of interest exists which inhibits participation in the Sovereign Sunshine program and in any publicity reasonably required surrounding its participation and / or the receipt of a donation from Sovereign Sunshine.
Support from Sovereign
Each month Sovereign staff will nominate up to six New Zealand based children’s charities which will be eligible to receive a financial donation from Sovereign. Sovereign will only nominate charities which have agreed to participate in the Sovereign Sunshine program and have not been shortlisted previously in this calendar year.
Six monthly financial donations will be made each month, totalling up to $15,000 from Sovereign (including any money raised by Sovereign staff). Sovereign will donate a minimum of $10,000 and match funds raised by its staff to an additional $2,500 per month. The recipients of the financial donations will be the six shortlisted charities. The charity which receives the most eligible votes from members during the voting period will be the winning charity. An eligible vote is a vote by a registered member for a nominated children’s charity using the voting function of the Website. A registered member may only vote once for a single charity in each monthly ballot. All determinations by Sovereign of which nominated charities will receive support for a particular month are final and no correspondence will be entered into.
The total donation of up to $15,000 will be divided between the six shortlisted charities.
$10,000 will be divided between the six monthly short-listed charities according to the proportion of the vote they receive. In addition to this, the winning charity will receive an additional donation.
Donations made by staff on Sunshine Day are matched dollar for dollar by Sovereign, up to a maximum of $2,500. The total of the staff donations and Sovereign’s matched contribution from Sunshine Day will also be given to the winning charity.
Where a charity has indicated that it is seeking volunteers, Sovereign makes no representations regarding the nature, availability or suitability of any volunteer work.
Where a charity has registered with the Website to accept donations, Sovereign accepts no liability in relation to such payments. All donations which are made by registered users to charities registered with the Website are made directly and are solely between the donor and the charity. Any mistakes, errors or queries must be addressed between the donor and the charity.
Intellectual Property
Sovereign owns (or has a licence for) all copyrights, database rights and all similar rights for the Website and all trademarks and other materials used excluding third party information and provided in relation to the charities participating in the Sovereign Sunshine programme. You may only use the information and reproduce it in hard copy for your personal reference or for a purpose permitted by the Website. Any copy of information must retain all copyright and other proprietary notices shown on the initial printout or download. You shall not in any circumstances obtain any rights over or in respect of the Website (other than rights to use the Website pursuant to these Terms) or hold yourself out as having any such rights over or in respect of the Website.
Links to Other WebsitesThe Website may contain hyperlinks to websites operated by parties other than Sovereign. Sovereign does not monitor or investigate all information on such sites and any links are provided for convenience purposes only. Sovereign accepts no responsibility or liability in relation to any content on any other websites.
Hypertext LinkingIf you do create a link to any of the pages on the Website, you acknowledge that you are responsible for all direct or indirect consequences of the link, and you indemnify Sovereign for all loss, damage, liability, costs or expense arising from or in connection with the link.
Jurisdiction
The content of this Website has been prepared in accordance with New Zealand law for persons resident in New Zealand only. The content of the Website and the Terms are governed by and construed in accordance with New Zealand law and New Zealand Courts have jurisdiction. All references to any currency are to New Zealand dollars.
